Special Education Destruction of Records for students who are not enrolled since 2020

NOTICE ABOUT 

EDUCATIONAL RECORDS:

According to district policy, we give notice that special education records of students that were enrolled in the district prior to 2020 and have since moved, exited special education, changed school districts, or graduated are no longer needed to provide educational services to individuals with disabilities. [Note: We need to retain records for 6 years after the loss of district enrollment, exited SpEd services, or graduated. For example if your child with special needs graduated in 2021, we will be able to release those records in 2027.]

To best protect students’ confidentiality and avoid improper use or unauthorized disclosure, these records will be destroyed after May 15, 2026.

Please be aware that if you have educational records, these records may be needed for social security benefits or other purposes in the future. Please contact us (208-356-8802 option 8) before May 15, 2026 to arrange to pick up your records.

Update to orginal post:
By law and district policy, we retain records for a minimum of 6 years after the student is no longer eligible for Special Education. A student generally becomes ineligible by:
a. moving from the district or unenrolling
b. graduating from high school
c. aging out (turning 21)
d. parents revoked services

If a student graduated in the spring of 2022, then we would retain the records until the spring of 2028. Due to privacy laws, we can not post a list of students who's files will be destroyed. However, we do send a letter to the child's last known address notifiying the former student / family that this process will soon take place.

We highly encourage families to pick up their child's educational file when that becomes available. After a time period you decide that it is not needed, then I would encourge you to destroy the file in a manner that would not leave identifiable information in a format that identify theft could occur.
